Introduction

These Terms & Conditions (“Terms”) govern your use of the Medina Tire Service website, online forms, appointment scheduling, delivery requests, quotes, and any purchases or services provided (collectively, the “Services”). By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Eligibility & Your Responsibilities

  • You must be 18 years or older to use or purchase through the Services.
  • Information you submit (vehicle details, contact info, delivery address) must be accurate and current.
  • You are responsible for all activity conducted from your device/browser/account.

Quotes, Pricing & Availability

  • Quotes are estimates and typically valid for 7 days unless otherwise stated.
  • Prices may change based on supplier costs, availability, surcharges, taxes, shipping, or market conditions.
  • Inventory and pricing are subject to change and may contain errors; we may correct errors and cancel affected orders (with a refund if already paid).
  • Additional charges may apply (mounting/balancing, TPMS service kits, valve stems, shop supplies, disposal/recycling fees, alignment, specialty fitment work).

Orders, Deposits & Special Orders

  • Deposits may be required to source or hold items.
  • Special orders (non-stock sizes/lines, custom wheels) may be non-cancelable and non-refundable once placed with suppliers.
  • We may refuse or cancel any order due to suspected fraud, pricing/stock errors, or other reasonable concerns (refunds provided for canceled, paid orders).

Appointments, Cancellations & No-Shows

  • Please arrive on time; late arrivals may need to be rescheduled.
  • Cancel at least 24 hours in advance when possible.
  • No-shows or repeated last-minute cancellations may incur fees or limit scheduling.
  • We may reschedule or refuse service where safety, vehicle condition, or staffing constraints require it.

Delivery, Shipping & Risk of Loss

  • For shipments, we may use FedEx (or a comparable carrier). We share only the minimum necessary information (name, address, phone, order details) to create and confirm your shipment.
  • Delivery dates are estimates; we are not liable for delays outside our control (carrier issues, weather, supply chain).
  • Risk of loss transfers upon delivery to your address or when you/your agent take possession.
  • Inspect shipments on arrival; damage/shortage must be reported within 48 hours with photos and packaging retained.

Fitment, Installation & Safety

  • Provide accurate vehicle details (year/make/model/trim, tire size, load/speed).
  • Fitment guidance is based on industry references; wheel offsets, suspension mods, and load needs can affect results.
  • Alignment is recommended with new tires; torque re-check after 50–100 miles.
  • TPMS components may require service/replacement; extra charges may apply.
  • Customer-supplied parts/tires are installed as-is; we are not responsible for age, defects, or compatibility.

Returns, Exchanges & Refunds

  • New, unused tires may be returnable within 7 days, subject to inspection, restocking fees, and shipping costs.
  • Mounted/used tires are not returnable unless there is a verified defect under manufacturer policy.
  • Special orders and electrical/TPMS items are generally non-returnable.
  • Contact us for an RMA and instructions; items must be in original condition.

Manufacturer Warranties & Road Hazard

  • Manufacturer mileage/workmanship warranties are provided by the tire manufacturer.
  • Warranty eligibility requires proper maintenance (rotation intervals, alignment, inflation records).
  • Road hazard coverage is not included unless separately purchased and stated.
  • Our service warranty is limited to workmanship performed as stated on your invoice.

Payments, Chargebacks & Collections

  • We accept common payment methods (e.g., major credit/debit cards).
  • By paying, you authorize charges for agreed amounts, taxes, and approved add-ons.
  • Chargebacks on valid transactions may result in service suspension and will be disputed with documentation.
  • Unpaid balances may accrue lawful late fees and be referred to collections.

Acceptable Use of the Website

  • No unlawful use or harassment/abuse of others.
  • No attempts to bypass security, probe non-public systems, or disrupt performance.
  • No malware, spam, or automated scripts that degrade service.
  • No scraping/crawling of content without written permission.

Intellectual Property

All content on this website (text, logos, graphics, images, layout) is owned by Medina Tire Service or our licensors and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute content without prior written consent.

Third-Party Links & Providers

Our website may link to third-party sites (e.g., tire manufacturers) and relies on third-party providers (e.g., Vercel for hosting, Neon Postgres for database, Google Services for maps/email, and FedEx for logistics). We do not control third-party content or policies; your use of those services is governed by their terms and privacy policies.

Communications & Electronic Consent

By providing your contact details, you consent to receive service-related communications (appointment confirmations, delivery updates, order notices) by email, phone, or SMS, where applicable. You may opt out of non-essential marketing at any time. Service-critical messages may still be required to fulfill your order.

Disclaimers

  • No guarantee of availability; inventory and pricing may change without notice.
  • We strive for accuracy but do not warrant that product descriptions, fitment data, or site content are error-free.
  • The website is provided “as is” and “as available”; we disclaim all implied warranties to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Medina Tire Service is not liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising from or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid to Medina Tire for the specific product or service giving rise to the claim. Some jurisdictions do not allow certain limitations; some terms may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Medina Tire Service and our owners, employees, and agents from any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or violation of law.

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supplier/carrier delays, epidemics, outages, or governmental actions.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a revised “Last Updated” date. Your continued use of the Services after changes are posted constitutes acceptance.

Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of state and federal courts located in Harris County, Texas for disputes arising out of or related to these Terms or the Services.

Severability & Waiver

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.
